Roundtable Sets Stage for State Legislation

The American Medical Association’s State Legislative Roundtable, an annual event held in August, brings together representatives from state medical associations, national specialty societies, and other national medical organizations to discuss issues relevant to state legislative affairs.  The meeting provides opportunities for legislative strategy development and for identifying legislative and regulatory trends across state lines.

During this year’s Roundtable meeting, issues that are likely to be on the agenda in some states during 2007 were discussed.  The issues include:  continued efforts to pass MICRA-style medical liability reforms; revision or repeal of Certificate-of-Need (CON) statutes; ongoing conflicts with nonphysician health care professionals and scope of practice expansion by legislative or regulatory means; and advocacy regarding the passage of fair contracting laws.  Surgeons should be aware that bills may be introduced in their state legislatures to address these issues.

  

Cosmetic Surgery Tax Repeal Efforts Still Under way

Efforts to repeal the cosmetic surgery tax in New Jersey are still ongoing.  Earlier this year, the Stop Medical Taxes Coalition put on a full court press to repeal this tax, with various advocacy activities implemented across the state.  It was hoped that the repeal would be included in the state budget, but that hope was not realized.

The New Jersey legislature will be in session in September, and it could bring the repeal bills (A-2282/S-1783) up for a vote in the Senate and the Assembly.  The New Jersey Chapter of the College has asked surgeons to contact their legislators through the Surgery State Legislative Action Center to urge them to act on this repeal legislation. 

 

 

Kansas Board of Healing Arts Adopts Regulations for Office-Based Surgery

The Kansas Board of Healing Arts has adopted new regulations that establish sanitation and safety standards for all medical practices that provide direct patient care. There are three levels of standards: (1) general requirements for all medical practices, (2) more stringent requirements for any medical practice where office-based surgery is performed, and (3) the highest level of requirements for any medical practice that performs procedures that require administration of general anesthesia or a spinal or epidural block. 

The Board of Healing Arts regulations do not apply to hospitals or ambulatory surgery centers because those facilities are licensed and regulated by the Kansas Department of Health and Environment. With the assistance of Medical Services Corporation, the Kansas Medical Society has developed a sample compliance policy to assist physicians in implementing the new general requirements for all medical practices. Most of these requirements are standards that are probably already a matter of routine practice. As the summer winds down, election season is heating up!  Several Web sites are available to help navigate this busy electoral time.

Surgery State Legislative Action Center

The SSLAC, supported by the American College of Surgeons (ACS) and 12 national surgical specialty societies, offers comprehensive information regarding upcoming elections.  After typing in your zip code or selecting a state, the site will allow users to register to vote, view upcoming important dates, and even learn more about individual races.

Stateline.org

Stateline’s election guide offers information about major races in each state and compiles news stories from newspapers throughout the country.

 ACS Participates in National Conference of State Legislatures Annual Meeting

Again this year, the College’s State Affairs staff participated in the annual meeting of the National Conference of State Legislatures (NCSL).  The College exhibits as part of the 12-member coalition “Physician’s Advocating for Patients.”  (See side bar for a complete list of coalition members.)

The National Conference of State Legislatures is the bipartisan organization that serves the legislators and staffs of the states, commonwealths, and territories. NCSL provides research, technical assistance, and opportunities for policymakers to exchange ideas on the most pressing state issues and is an effective and respected advocate for the interests of the states in the American federal system.

Each summer, NCSL brings thousands of legislators and staff together for the largest meeting of its kind in the nation. The annual meeting provides more than 150 informative sessions and presents nationally renowned speakers on the issues that matter. This meeting provides a forum in which legislators and their staffs can meet with a variety of exhibitors and discuss important state issues, including such things as medical liability reform, health system reform, physician reimbursement and Medicaid, and scope of practice expansion by non-physicians.  (http://www.ncsl.org/annualmeeting/Exhibitors.htm)
